3. Refund in Failed Transaction
Since multiple Organizations and Financial Institutes and payment gateways are involved, reconciliation of failed transactions will be necessary. Hence, refund in the event of failed transactions
is not guaranteed for accuracy and timeline.
4. Prohibitions
(a) The user shall not contravene any applicable law and shall not use the service for any unlawful
purpose.
(b) This online platform shall not be used to send or receive any messages or posting of contents
which is offensive on moral, religious, racial or political ground or it is abusive, obscene, indecent
or defamatory spams, malware, misinterpretation, illegal contents. Floorkey is authorized
to remove, block such contents and terminate and / or suspend listing / subscription and
account of the user.
(c) The user shall not use information obtained from this website for any commercial use such as
selling informations to third party, telemarketing, bulk calling/SMS.
(d) The users shall not post listings / contents related to properties or products for which they do not
have ownership rights or duly authorized by the owner to publish the same on this website.
(e) The user shall not post or transmit any information or contents which contains virus of any kind
and violate network and system security.
(f) The user shall not use manual or automated software, applications, devices scripts, robots to
access, scrape, crawl or spider any webpage or other informations or contents on this website.
In any of above cases, Floorkey has right to initiate legal proceedings and claim damages and
and all revenue generated due to such use.
5. Termination and Suspension of Services
Floorkey at its sole discretion may terminate, restrict or suspend your use or access to the website
or your listing / subscription, any time without notice, based on its information, verification and
judgment of violation or breaches of this agreement of Terms and Conditions. On termination the
subscription / listing fees shall be forfeited.
6. Indemnity
You agree, indemnify and hold harmless "Floorkey" and Ace Digibits LLP, their partners, employees
and representatives from and against any and all liabilities, claims, costs and expenses that arise out
of or in connection with your use of this website.
7. Prices and Taxes
Prices of listing / subscription are subject to changes without notification and includes Taxes
and Levies applicable at Mumbai, India. If user is outside this territory / country he will be liable
to pay taxes & levies applicable as per location of the user. Floorkey shall not be responsible for
fluctuation in exchange rate of currency.
8. If any provisions of this agreement are invalid or unenforceable, the remaining provisions
will continue to be valid and enforceable.
9. Irrespective of Territory and Jurisdiction of access to Floorkey, Courts at Mumbai, India will have
exclusive jurisdiction in all claims and legal matters in respect of Floorkey.
10. Any material changes in this Privacy & Disclaimer Policy or Terms and Conditions of the agreement,
wherever required, will be displayed on the website and may be notified to you via email address
that you maintain with us.
11. Owners of this website may sell, transfer, share some or all assets in case of a merger, acquisition
or sale with existing or modified terms and conditions with the user.
8. Refund on Unlimited Listings:
Refund will be given to buyers of unlimited package if they meet all of following conditions:
a. There should be atleast 10 listings posted in Unlimited package
b. None of the listings under unlimited package has received any lead over 3 months of unlimited package.
c. Lead is defined as: Any sum of "total views, total bookmarks, total contact form, total phone view details, total search". Hence, Lead is sum of all counters for a property.
d. The listings under unlimited package should not have changed for atleast 2 months.
If all these conditions are met, you can raise a refund request by filling contact form at Contact Us or write to us at admin@floorkey.com with your transaction ID and your account email. Your request will then be processed for verification and approval.
